Mr. Verma seeks permission to withdraw the petition with respect to the petitioner no. 1, who has died during the pendency of this application.

The petition with respect to the petitioner no. 1 is dismissed as having become infructuous.

The petitioner nos. 2 and 3 seek bail in anticipation of their arrest in connection with Mairwa P.S. Case No.

Patna High Court CR. MISC. No.13031 of 2021(2) dt.24-12-2021 2/3 122/2020 instituted for the offence under Sections 341, 323, 324, 504, 498A/34 of the Indian Penal Code. The petitioner nos. 2 and 3 are the sister-in-law and the brother-in-law of the informant.

The learned senior counsel for the petitioners has submitted that the husband of the informant has been granted anticipatory bail by a Bench of this Court. Apart from this, it has been submitted that the petitioner no. 3 is in Government service posted at Gorakhpur where he resides with his family i.e. petitioner no. 2 and others. The petitioner nos. 2 and 3 do not have any concern with the affairs of the husband of the informant.

Regard being had to the general nature of accusation against petitioner nos. 2 and 3 and that also because of their being related to the husband of the informant, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two
