The petitioner seeks bail in connection with Buddha Colony P.S. Case No. 321 of 2013 registered for offence under section 25 (1-b) a/26 of the Arms Act Allegedly, acting on a tip off, a raid was conducted and the petitioner was caught and on search, one loaded country made pistol was recovered.

Submission at the bar for release of the petitioner is that the petitioner is suffering in custody since 28. 12. 2013 and the search and seizure are not in accordance with law. The petitioner has been sufficiently punished by remaining in custody to which the

In the facts and circumstances stated above, considering the period of detention, the petitioner Randhir Kumar @ Randhir Yadav is directed to be released on bail on execution of bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ravi Ranjan, learned Judicial Magistrate 1st class, Patna in connection with Buddha Colony P. S. Case No. 321 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
