====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in connection with Bhagwan Bazar P.S.Case No. 42 of 2013 registered u/s 379/411 IPC.

As per the FIR allegation against the petitioner is to have opened the bag, took out Rs.1,000/- and tried to flee away but was caught along with Rs.1,000/-.

Petitioner is carrying two criminal cas3es over his head. He is in custody since 29th March 2013.

In the facts and circumstances of the case, let petitioner Bhola Dom be enlarged on bail on his furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Bhagwan Bazar P.S.Case No. 42 of 2013, subject to

Patna High Court Cr.Misc. No.50127 of 2013 (3) dt.24-12-2013 2/2 the conditions that :

(i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future , prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass order, including cancellation of bail.
