ANJANA MISHRA ORAL ORDER 23-12-2014 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 06.07.2013 in Kotwali P.S. Case No. 304/13 (S.Tr. No.1184/13) for the offence under Section 302 of I.P.C.

The allegation against the petitioner is that he was seen at the place of occurrence where the deceased Ganesh Prasad was murdered and the informant on hearing hulla found the petitioner with knife in his hand. The informant tried to catch the petitioner but the petitioner ran away from the place of occurrence. Considering the fact that there is direct allegation against the petitioner for having used knife and killing the said Ganesh Prasad, I am not inclined to grant bail to the petitioner. It
