1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 406, 420, 467, 468, 471, 504, 365 and 120(B) of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioners is a person with clean antecedent, it is further submitted that Prabhat Kumar Srivastava had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 11794 of 2022 and the same came to be allowed by an order dated 12.09.2022, it is next submitted that case of the petitioner if not akin is similar to the case of Prabhat Kumar Srivastava, it is further submitted that in sum and substance, the complainant

No.17023 of 2026(2) dt.31-07-2026 2/3 alleges that he asked for a job from the petitioner, who in turn asked the complainant to bring mark sheet, certificates and Rs.5,000/- on 25.04.2019 and went to the Registry Office with three accused persons including the petitioner and two unknown accused persons, it is next alleged that Prabhat Kumar Srivastava asked the complainant to sign on 3-4 stamp papers, but on intervention, the complainant was stopped from signing on the stamp papers, it is next alleged that Shambhu and petitioner took the documents and Rs. 5,000/- and both accused further forced him to sign on the stamp papers, it is also alleged that all the accused assaulted the victim and further took his sign on stamp blank papers, it is next alleged that the occurrence took place for capturing the land of the complainant as the land which originally was in the name of his grand father now belongs to the complainant.

Learned counsel for the petitioner submits petitioner has been falsely implicated in the instant case by the complainant, it is next submitted that complainant instituted a complaint case in the year 2019 and the petitioner was completely unaware that a criminal case has been instituted against him, it is further submitted that petitioner never received any summons or bailable warrants, but all of a sudden when the police started knocking the doors of the petitioner he came to know that a non-bailable

No.17023 of 2026(2) dt.31-07-2026 3/3 warrant of arrest has been issued, it is next submitted that though it is alleged that petitioner made complainant sign on some blank stamp paper, but then the same till date has not been misused, it is further submitted that complainant died during pendency of the complaint case.

5. Learned A.P.P. for the State and opposes the anticipatory bail application of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint. Case No. 1095 of 2019 subject to the conditions as laid down under Section 482 (2) of the BNSS.

7. The application stands allowed.
