JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One country made pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner. Petitioner does not have any criminal antecedent. So far as the offence under Section 364 of the Indian Penal Code is concerned, the so-called victim, namely, Bholu has not made any allegation of his kidnapping rather he stated before the police that he had come there on the invitation of petitioner and other accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.57436 of 2015 (2) dt.22-12-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil (Singhaul) P.S. Case No. 277 of 2015.
