The petitioner is in custody in a case registered under Sections 379 and 411 of the Indian Penal Code. Taking into consideration that the petitioner is said to have caught with mobile just after the occurrence, I am not inclined to release the petitioner on bail. Accordingly, his prayer for bail in connection with Ara Rail P.S.Case No. 43 of 2015 pending in the Court of learned Railway Judicial Magistrate, Ara stands rejection.

However, the trial court is directed to expedite the trial of the petitioner and try to conclude the same within a period of three months from the date of receipt/ production of a copy of this

Patna High Court Cr.Misc. No.57379 of 2015 (2) dt.21-12-2015 order, failing which the petitioner may renew his prayer for bail before the learned court below itself.
