Petitioner apprehends his arrest in Khajekalan P.S. Case No.91 of 2013 instituted under Section-420 of the Indian Penal Code, Section-63 of the Copy Right Act and Section-103/104 of the Trade Marks Act.
Learned counsel for the petitioner submits that Section420 of the Indian Penal Code has been added only to make offence grave otherwise it is best an offence of the Copy Right Act. I am amazed at the submission of the learned counsel for the petitioner because petitioner was manufacturing cosmetics purporting to those manufactured by the Hindustan Unilever Limited, a manufacturing firm of some repute. Thus, petitioner was definitely trying to cheat the customers.
Be that as it may, I am not inclined to grant the privilege of anticipatory bail to the petitioner. If the petitioner surrenders or arrested within four weeks from today, he may pray for regular
Patna High Court Cr.Misc. No.30862 of 2013 (03) dt.23-12-2013 2/2 bail before the Court below which will be considered on its own merits, without being prejudiced by this order. Accordingly, this application is dismissed.
