The petitioner apprehends his arrest in connection with Saraiya (Jaitpur O.P.) P.S. Case No.617 of 2019, registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.

The petitioner is said to have withdrawn the government money sanctioned under the scheme Nal Jal Yojana and misappropriated the same.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioner is Panchayat Secretary and he has no role to play in the present case.

Patna High Court CR. MISC. No.13993 of 2022(4) dt.12-12-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner by submitting that the petitioner has misappropriated the government money and the work allotted to the petitioner is against the Rule. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
