JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 390 of 2010 registered under Sections-341, 342, 323, 498(A), 406, 504, 120B of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act.
Taking into consideration that the petitioner is husband of the complainant and there is allegation of torturing against him and not only this, but when learned Sessions Judge attempted to patch up the dispute of the parties, this petitioner spit on the body of the complainant, I am not inclined to extend the privilege of anticipatory bail to the petitioner and accordingly, prayer for anticipatory bail of the petitioner in connection with Complaint Case No. 390 of 2010 stands rejected.
