JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Forest Case No. 07 of 2013/Crime Report No. 26075 registered for the offence punishable under Section 33 of the Bihar Forest Act.

The accusation against the petitioner is that he encroached the notified forest land.

The contention on behalf of the petitioner is that several litigation is pending between the parties in respect of land in question.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/

Patna High Court Cr.Misc. No.39555 of 2013 (2) dt.24-12-2013 surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Forest Case No. 07 of 2013/Crime Report No. 26075 subject to condition as laid down under Section 438(2) of the Cr.P.C.
