BADAR ORAL ORDER 20-12-2021 The applicant/accused in Sessions Trial No.428 of 2019 pending on the file of the learned Additional Sessions Judge-I, Bagaha, West Champaran, is seeking his release on bail for the offences punishable under Sections 302, 120(B) read with Section 34 of the Indian Penal Code as well as under the Arms Act.
Heard learned counsel appearing for the applicant/ accused. He fairly pointed out that earlier the bail application of the applicant was rejected by this Court vide order at Annexure1. He pointed out that the report has been called for from the concerned trial court by this Court.
I have considered the submissions so advanced. Perused the report of the learned trial court.
Patna High Court CR. MISC. No.25264 of 2021(3) dt.20-12-2021 2/2 Earlier, the bail application of the applicant was rejected on merit by my learned Predecessor.
Now, the trial has already started and two witnesses have already been examined by the learned trial court. In this view of the matter, it will not be proper to entertain the instant application. The same is therefore rejected. However, the learned trial court is directed to expedite the trial keeping in mind that the applicant is the under trial prisoner. (A. M. Badar, J) P.S./- U T
