BADAR ORAL ORDER 20-12-2021 The applicant/accused in Crime No. 124 of 2020 registered with Chakand Police Station for the offences punishable under sections 147, 149, 341, 323, 302, 504 and 506 of the Indian Penal Code, by this application is seeking his release on bail during pendency of the trial. Heard the learned counsel for the applicant. He submits that omnibus allegations are levelled against the applicant and therefore, he is entitled to bail. Learned APP opposes the application.

I have considered the submission so advance and also perused the material placed before me. The dead body of the deceased was found to be having injuries and autopsy surgeon has opined that death was due to haemorrhage and shock. The

No.26776 of 2021(4) dt.20-12-2021 2/2 allegations in the FIR lodged by the eye-witness named Roshni Devi is to the effect that when her son Badal Kumar had gone out for easing, the applicant along with the other accused persons formed an unlawful assembly assaulted him, causing his death.

Considering the eye-witness account given by the first informant, no case for grant of bail is made out. It is rejected accordingly.
