SINHA ORAL ORDER 24-12-2013 Heard learned counsel for the petitioners and the State. Petitioners are apprehending their arrest in connection with a case registered for the offence under Sections 498A, 304B/34 of the Indian Penal Code. There is omnibus allegation against the father-in-law, brother-in-law and the husband of the deceased that they not only assaulted, but also administered poison to the deceased.
It is submitted on behalf of the petitioners that the husband of the deceased has already been admitted to the privilege of bail by this Court. There being hardly any distinguishing feature to separate the case of the petitioners with the case of the husband. I am not inclined to entertain the present application for grant of bail in the event of arrest on behalf of the petitioners. Let petitioners above named surrender in the court Chief Judicial Magistrate, Banka in connection with Shambhuganj
Patna High Court Cr.Misc. No.28715 of 2013 (3) dt.24-12-2013 P.S. Case No. 158 of 2010 within four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail in the light of the order passed in the case of the husband.
