Mr. Ashok Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 20-07-2026 Heard learned counsel for the petitioner, learned APP for the State and perused the case diary.

2. The petitioner is in custody in a case registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per allegation in the FIR, the petitioner along with three co-accused persons were planning to commit some crime at BR03, Smoke Tea shop where the informant and his police party reached the said place and saw that four persons coming out of the shop, tried to flee away but they were apprehended by the police and the apprehended persons disclosed their names and one mobile phone as also three live cartridges were recovered from the possession of the petitioner

Patna High Court CR. MISC. No.25975 of 2026(4) dt.20-07-2026 2/3 and the informant informed to the police that co-accused Bickey Giri gave contract of Rs.2 lacs to commit the murder of Himanshu Sharma who was involved in the murder of Sikandar Bind.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the petitioner has no knowledge about the alleged occurrence has no concern with the alleged crime, there is general and omnibus allegation against him and nothing any article has been recovered from the conscious possession of the petitioner and he is in custody since 27.11.2025.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

On perusal of the first information report, case diary and impugned order dated 11.02.2026, it appears that the petitioner was given a contract of Rs.2 lakh by co-accused Bickey Giri @ Sadhu Giri to commit the murder of Himanshu Sharma and he was also provided a pistol by co-accused Bickey Giri which was seized by the police from the possession of the petitioner and several witnesses have also supported the case of the prosecution as appears from paras-3, 4, 5, 6 and 7 of the case diary, the two cases are pending against the petitioner, the

Patna High Court CR. MISC. No.25975 of 2026(4) dt.20-07-2026 3/3 allegation against the petitioner is very serious, so I am not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

8. The petitioner is directed to renew his prayer for bail before the concerned Trial Court after completion of one year in custody.
