JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2014 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 167, 197, 416, 420, 421, 422, 423, 406, 465, 466, 467, 468, 471, 120B, 323, 504 and 506/34 of the Indian Penal Code.

It is alleged that the informant gave his photograph and other documents to the petitioner for sanction of money under Indira Awas Scheme. Subsequently, the informant received notice from the bank and then he came to know that the loan of Rs. 27,000/- was sanctioned which was withdrawn by the petitioner. It is submitted by learned counsel for the petitioner that the case has been lodged after about six years of taking loan and this is not the case of bank that the loan was not taking by the informant. A statement has been made in para 3 of the petition that

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Salkhua P.S. Case No. 52 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
