NILU AGRAWAL ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 22.10.2016 in connection with Lodipur P.S. Case No. 110/16 registered for the offence punishable under Section 30 (a) of the Bihar Excise (Amendment) Act.

The prosecution case, as lodged by the police personnel, is that during course of patrolling they intercepted one motorcycle and found the petitioner driving the motorcycle and other person Dharmendra Kumar possession a bag containing 27 litres of foreign liquor. Accordingly, a seizure list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history, nothing

Patna High Court Cr.Misc. No.54676 of 2016 (2) dt.23-12-2016 2/2 has been recovered from his conscious possession and that charge sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.

However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, considering the facts and circumstances and submission of the parties, since charge sheet has already been submitted, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-IV, Bhagalpur, in connection with Lodipur P.S. Case No. 110/16. (Nilu Agrawal, J.) Rajesh/- U T
