JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 Petitioner prays for bail in connection with Sursand P.S.Case No. 267 of 2018 registered for the offences punishable under Sections 414 of the Indian Penal Code, 30(a), 38 and 41 of Bihar Prohibition and Excise Act.
Allegation is of recovery of 72 litres of liquor from the motorcycle of the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 5.10.2018, having no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five
Patna High Court Cr.Misc. No.76379 of 2018(2) dt.21-12-2018 2/2 thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi, in connection with Sursand P.S.Case No. 267 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
