2. The petitioner is in custody in a case registered for the offence punishable under Sections 61(2), 103(1), 351(2) and 351(3) of the BNS and Section 27 of the Arms Act.

3. The petitioner and others are accused of getting the witness of a sessions trial killed. The name of the petitioner has come in the self-inculpatory and petitioner is in custody since 20.09.2025 and he has got ten criminal antecedents.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the petitioner has no knowledge about the alleged occurrence has no concern with the alleged crime. He next

Patna High Court CR. MISC. No.25792 of 2026(5) dt.20-07-2026 2/2 submits that three co-accused persons have already been granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. Nos.15789 of 2026, 19791 of 2026 and 20667 of 2027.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that one co-accused has been rejected bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No.29407 of 2026.

On perusal of the first information report, case diary and impugned order dated 21.01.2026, it appears that there are sufficient evidence against the petitioner in the case diary and the petitioner and other co-accused persons have committed the murder of deceased as the deceased is an eye witness of Gaurichak P.S. Case No.210 of 2020 which is against the petitioner and the petitioner has got criminal antecedent of heinous offence, so I am not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
