Mrs. Asha Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 20-07-2026 Heard learned counsel for the petitioner, learned APP for the State and perused the case diary.

2. The petitioner is in custody in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 352, 351(2) and 3(5) of the BNS and Section 27 of the Arms Act.

As per allegation in the FIR, the informant has alleged that co-accused Rinki Mishra came the door of the informant and started abused and on protest, she started scuffling with her and threatened to kill her and two sons of coaccused Rinki Mishra put illegal pistol to the neck of the daughter of the informant and threatened to kill her and during course of scuffle, the petitioner made several fires by illegal pistol.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to previous enmity. He next submits that the petitioner has no knowledge about the alleged occurrence and he is in custody since 24.01.2026.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. On perusal of the first information report, case diary and impugned order dated 24.02.2026, it appears that the petitioner put the pistol on the neck of the daughter of the informant and threatened to kill her and in course of that, the petitioner made several fires by illegal pistol, resulting there was a whole in the iron gate of the informant and the cartridges were recovered from the place of occurrence. One case is also pending against the petitioner, i.e., Lakhanour P.S. Case No. 56 of 2024 and also the fact that several witnesses have supported the case of the prosecution and the case is found to be true under Section 126(2) from para no.58 of the case diary, so I am not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

8. The petitioner is directed to renew his prayer for
