This application for regular bail arises out of Laukahi P.S. Case No. 195 of 2019, G.R. No. 1565 of 2019, disclosing the offence punishable under Sections 304-B/302/201 of the Indian Penal Code.

The petitioner is the husband of the deceased. The deceased was married to the petitioner on 28.03.2019. There is allegation of demand for dowry against the petitioner and the family members and torture therefor. It is alleged that the deceased was first killed and thereafter her dead body was set on fire in her in-laws house itself to get the evidence disappeared by the accused persons.

It is the case of the petitioner, on the other hand, that

The deceased was pushed by the female members of the family from varandah whereafter she had fallen down in the court-yard and received serious injuries. In reaction to that, she went inside her room and bolted the door from inside. Despite the efforts made by the petitioner she did not open the door in the evening because of which the petitioner was made to sleep outside the room. In the night, the petitioner felt smoke coming out of the room in which the deceased had locked herself which was bolted from inside. He thereafter started screaming, upon which the neighbours gathered and all started attempting to pacify the fire. The police was also informed and when they reached there they found the room locked from inside.

The narration of the petitioner of the story, as noted above, does not inspire much confidence for the purpose of grant of regular bail. It is difficult to accept, for the present, that though the petitioner was present outside the room he had to wait for the police to break open the door in which his wife was there and fumes of smoke were coming out. The petitioner's submission that the deceased had committed suicide and, therefore, the petitioner deserves regular bail cannot be

This application is accordingly rejected.
