The petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 219 of 2016, registered under Sections 308/34 of the Indian Penal Code.
The allegation against the petitioner is that due to his carelessness, the informant came into contact of electricity and thereafter, he fell down on the earth and injured. Learned counsel appearing on behalf of the petitioner submits that petitioner, being a Junior Engineer, PESU ordered the informant to do the work of transformer, but all of sudden, he fell down due to moving of birds one phase of fidder touched the shut down fidder, as a result of which, power came in the fidder and the informant got electrocuted. Patna High Court Cr.Misc. No.55515 of 2016 (2) dt.23-12-2016 2/2 Annexure-2, it appears that the informant is being treated properly at ESIC Hospital and in the said incident, neither the petitioner nor any employee is responsible.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Patna City in connection with Sultanganj P.S. Case No. 219 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shail/- U T
