Petitioner apprehends his arrest in connection with Srinagar (Pujaha) P.S. Case No. 8 of 2013 registered under Sections- 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.

The allegation against the petitioner is that he alongwith Panchayat Rozgar Sewak have fraudulently withdrawn government money.

Learned counsel for the petitioner submits that in course of investigation, DDC, West Champaran furnished his enquiry report and the report of the enquiry team constituted by the Collector, West Champaran vide letter dated 25.01.2014 wherein it has been clearly recorded that in both the enquiry

Patna High Court Cr.Misc. No.55455 of 2016 (2) dt.23-12-2016 nothing has come relating to the petitioner with regard to financial misappropriation. It is further submitted that while the petition filed by the Investigating Officer seeking permission for further investigation was pending before the Chief Judicial Magistrate, Investigating Officer filed an application seeking Warrant of Arrest against the petitioner on frivolous grounds. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Srinagar (Pujaha) Case N. 8 of 2013 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
