JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hajipur Sadar Police Station Case No. 230 of 2016 registered for the offences punishable under Sections 394, 302 of the Indian Penal Code.

No doubt, petitioner is not named in the first information report but the present case has been lodged for the offence punishable under section 302 of the Indian Penal Code and 27 of the Arms Act and in course of investigation, the name of petitioner came in confessional statement of co-accused. The investigation against the petitioner is still pending and, therefore,

Patna High Court Cr.Misc. No.51575 of 2016 (2) dt.23-12-2016 2/2 in my view, it is not a fit case for grant of anticipatory bail to the petitioner and, accordingly, his prayer for anticipatory bail in connection with Hajipur Sadar P.S.Case No. 230 of 2016, pending in the court of Chief Judicial Magistrate, Vaishali at Hajipur stands rejected.
