2. The petitioner seeks regular bail in connection with Nawada Cyber P.S. Case No. 08 of 2026, lodged on 17.01.2026, for the offences punishable under Sections 303(2), 318(2), 318(4), 319(2), 336(2), 336(3), 338, 340(2), 317(2), 317(5), 111(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023.

The prosecution case, in brief, is that, on the basis of information received through the Pratibimb Portal regarding mobile numbers, used for cyber fraud, police conducted a raid in the village Chainpur on 17.01.2026 during which the petitioner was apprehended in a field while conversing with someone on mobile phone. It is further alleged that upon search, one mobile phone of Poco brand was recovered from the possession of the petitioner containing several documents relating to cyber fraud

No.38008 of 2026(4) dt.31-07-2026 2/3 were recovered, including Aadhaar Card numbers, QR codes and mobile numbers allegedly used for cheating individuals in the name of Bajaj Finance Company for providing loans. It is also alleged that during the raid and as per record, one of the victim paid Rs. 33,000/- on the QR code sent by the petitioner. It is also alleged that upon further interrogation, the petitioner confessed that he was part of Nalanda based cyber gang allegedly managed by Ritesh Kuma via whatsapp group named as "Jai Mata Di". Further investigation revealed recovery of SIM card which was registered in the name of a third party from Jharkhand and was linked to multiple registered fraud complaints.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case solely on the basis of suspicion. Learned counsel for the petitioner further submits that the criminal antecedent of the petitioner is clean and he is in custody since 18.01.2026. The counsel lastly submits that seizure list indicates the time of seizure as 3:00 P.M., whereas the First Information Report was lodged at 4:30 P.M.

5. The learned APP for the State vehemently opposed the prayer for bail of the petitioner.

6. Having heard the parties, I am of the considered view that since the petitioner has clean antecedent and charge-sheet has been filed, let the above named petitioner be released on bail on

No.38008 of 2026(4) dt.31-07-2026 3/3 furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Nawada in connection with Nawada Cyber P.S. Case No. 08 of 2026, subject to the following conditions:

(I) One of the bailors shall be the petitioner's own or close family member.

(II) The petitioner shall appear on each and every date fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.

(IV) The Petitioner shall not commit offence of a similar nature in future.

In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
