Petitioners are seeking anticipatory bail in connection with Dulhin Bazar P.S. Case No.. 211 of 2018 registered for the offences punishable under Sections 342, 324, 326 and 307/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Learned counsel for the petitioners submits that petitioner no.1 is the grandmother-in-law, whereas, petitioner no. 2 is the mother-in-law of the informant. Learned counsel submits that the husband of the informant is already in custody. So far as these two petitioners are concerned they are old age ladies and have been falsely implicated in the present case even though they have nothing to do with the family of the deceased
Patna High Court Cr.Misc. No.75216 of 2018(2) dt.21-12-2018 2/2 and husband. It is submitted that in course of investigation also nothing has been found against them.
In the given facts and circumstances of the case, where it is the submission of the petitioners that they are old age ladies and nothing has come against them in course of investigation and they are living separately, in case of arrest or surrender of the petitioners within a period of four weeks from today, the abovenamed petitioners shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judical Magistrate-3rd, Danapur, District- Patna in connection with Dulhin Bazar P.S. Case No.211 of 2018 Subject to the condition that petitioners shall join the investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of their bail bond. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
