JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Industrial P.S. Case No. 33 of 2018 instituted for the offences under Sections 8/20(b)(ii) (c)/25/29 of the Narcotic Drugs & Psychotropic Substances Act, 1985.
After some arguments, Mr. Ranjeet Kumar Singh, learned counsel for the petitioner seeks permission to withdraw the present petition in order to enable the petitioner to surrender before the Court below and seek regular bail.
In case, such a petition is filed within a period of four weeks from today, the Court below shall take into
Patna High Court Cr.Misc. No.72827 of 2018(2) dt.21-12-2018 2/2 account that the name of the petitioner transpired in the confession of a co-accused person and that nothing has been recovered from his possession. The Court below shall also take into account that petitioner bears clean antecedents and some of the F.I.R. named accused persons have been granted regular bail and shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail petition has not been entertained. The petition is dismissed as withdrawn with the liberty aforesaid.
