The petitioner apprehends his arrest in Trial No.1785 of 2016 arising out of Motihari Town P.S. Case No.29 of 2004 registered under Section 307 and other Sections of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Name of the petitioner surfaced in the case on the confessional statement of co-accused but it appears that case was instituted in the year 2004. The investigating officer submitted chargesheet against the petitioner declaring him absconder. Since the petitioner has already been declared absconder, the prayer for anticipatory bail of the petitioner is rejected. If the petitioner surrenders in the court

Patna High Court Cr.Misc. No.74673 of 2018(2) dt.20-12-2018 2/2 below and pray for regular bail, the same shall be considered on its own merit.
