2. The petitioner is in custody in a case registered for the offence punishable under Sections 80 and 3(5) of the BNS, 2023.
3. As per allegation in the FIR, it is a case of dowry death due to non-fulfilment of dowry demand of a motorcycle by the petitioner and other family members, petitioner is the husband of the deceased and the marriage of the deceased within two years of the alleged occurrence.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner is the husband of the deceased, namely,
Patna High Court CR. MISC. No.32716 of 2026(3) dt.23-07-2026 2/3 Kajal Kumari. He next submits that the said deceased is little short tempered lady and always wants to do whatever came in her mind in a hurry and for a every petty issue, she became angry and on the alleged date of occurrence, she told to her mother-in-law that some spices is out of stock for which motherin-law replied why you not said me it earlier when I went out his infuriated her, after that mother-in-law went outside to buy said article and deceased remain alone in home as father-in-law and her husband was also not present in house at the time of alleged occurrence and she herself committed suicide after talking with the informant which the informant accepted and stated in her re-statement before the police as stated in para-9 of the petition. Petitioner has got clean antecedent as stated in para-3 of the petition and he in custody since 06.02.2026
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the petitioner is the husband of the deceased and marriage of the deceased with the petitioner within two years of the alleged occurrence.
6. On perusal of the first information report, case diary and impugned order dated 13.03.2026, it appears that the petitioner is husband of the deceased and he started demanding motorcycle and due to non-payment of dowry demand, the

No.32716 of 2026(3) dt.23-07-2026 3/3 informant's sister was killed and the marriage was performed within two years of the alleged occurrence as also the fact several witnesses have also supported the case of the prosecution, considering which, I am not inclined to grant bail to the petitioner.
7. Accordingly, the prayer for bail of the petitioner is hereby rejected.
