One country made loaded Katta and one live cartridge and other articles etc, were recovered from conscious possession of the petitioner when he was caught by the police along with two others going on a motorcycle which is said to be stolen property. According to the prosecution case itself, motorcycle was recovered from joint possession of three persons and so far as recovery of firearm is concerned, petitioner is in jail custody since 22.6.2015.

No doubt, petitioner carries criminal antecedent but taking into consideration the facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri P.K. Singh, Judicial Magistrate, Patnacity/ concerned court in Shahjahanpur P.S. Case no.
