SINHA ORAL ORDER 24-12-2013 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offence under Section 302 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is also said to have taken part in the assault. In the circumstances, he is not entitled for grant of bail in the event of arrest.
However, petitioner is directed to surrender in the court below, i.e., Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P. S. Case no. 42 of 2012, within a period of four weeks from the date of receipt/production of a copy of this order and apply for regular bail which should be considered in accordance with law.
