Petitioner is aggrieved by the order passed by the Collector dated 31.07.2018 passed in Supply Appeal No. 30/18. The order dated 31.07.2018 is quoted below:

3/4 ikfjr vkns"k esa dksbZ =qfV ugha gSA vr% muds }kjk ikfjr vkns"k dks ;Fkkor j[krs gq;s vihydÙkkZ ds vihy vkosnu dks [kkfjt fd;k tkrk gSA ys[kkfir ,oa la"kksf/krA lekgÙkkZ lekgÙkkZ lhrke<+h lhrke<+h From perusal of the order of the appellate authority, the court finds that without application of mind, the appellate authority has passed the order. In his discussion, he has noted that the Supply Officer in his report dated 23.10.2017 has stated that he is satisfied with the work of the petitioner as PDS Dealer. He also noted the circumstance which indicate that petitioner has been falsely implicated in this case. He also noted the fact that during investigation, the police did not find any material against the petitioner and submitted the final form against him, however, the Collector has dismissed the appeal.
Such consideration and decision totally lacks objectivity and application of mind and as such the order can not be sustained. Accordingly, the impugned order is quashed. However, quashing of the impugned order will not come in the way of the respondents, if any material surfaced to connect the petitioner with the offence of black marketing, the respondents shall take appropriate decision in accordance with law.
4/4 Otherwise, the petitioner would be entitled to restoration of his PDS licence.
