The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/411/34 of the Indian Penal Code.

The accusation is of committing theft of the oxen of the informant and his brother. Subsequently the accused were chased when mobile of the petitioner was recovered.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled when the informant has retracted from the initial version and filed petition to that effect before the learned court below.

The aforesaid facts constitute good ground for

Patna High Court Cr.Misc. No.39131 of 2013 (2) dt.24-12-2013 2/2 consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kumarkhand P.S. Case No. 83 of 2013 pending in the court of learned CJM, Madhepura.

With the aforesaid observation, this application is disposed of.
