Eight days after alleged date of occurrence, the victim after return from Hyderabad where she had gone along with petitioner, Guljar Ansari, whom she was entrusted by Md. Asif at Jasidih Railway Station as, Md. Asif allured her on the pretext of marriage. It is further evident from the written report as well as from her statement recorded under Section 164 of the Cr.P.C. (Annexure-2) that she had not alleged any untoward activity at the end of the petitioner during course of her stay at Hyderabad. Though, the victim has disclosed her age to be 14 years (minor), but considering the nature of allegation having attributed against the petitioner in consonance with the period of detention since 27.09.2016.

Guljar Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Banka in connection with Dhoraiya P. S. Case no.259 of 2015.
