====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR ORAL ORDER 31-07-2026 Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner seeks bail in connection with Barhiya P.S. Case No. 234 of 2025, instituted for the offences under Sections 126(2), 115, 109(1), 308(3), 329(3), 329(4), 117(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The Prosecution case, in short, is that on14.11.2025, the petitioner and co-accused Gopal Singh entered into the house of the informant and started abusing him and they took the informant to a mango orchard of the village and it is alleged that at the instance of co-accused Sonu Singh and Rakesh Singh the informant was assaulted resultantly, he sustained injuries to his hand and leg. It is alleged that the accused persons also demanded Rs. 50,000/- and threatened for dire consequences.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case on account of criminal antecedents. He further submits that there is no specific allegation of assault against the petitioner, the allegation against the petitioner is general and omnibus in nature.

5. Learned A.P.P. for the State, vehemently, opposed the prayer for grant of bail to the petitioner.

6. Having heard the parties. Considering the aforesaid facts and circumstances of the case and the nature and gravity of offence and also taking into account the criminal antecedent of the petitioners, this Court is not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
