2. The petitioner seeks regular bail in connection with Kishanganj P.S. Case No. 375 of 2026, for the offences punishable under Sections 126(2), 115(2), 303(2), 352, 351(2) and 3(5) of the B.N.S.

3. The prosecution case, in brief, is that as on 04.04.2026, around 04.00 pm, the informant, parked his motorcycle outside his house, but when he came out from his house, he found that the motorcycle was not parked there. It is further alleged that the CCTV footage, showed that two persons stolen his motorcycle. It is alleged that after identifying one of them as Md. Jamal, the informant went to his house where the suspect and his family members abused and assaulted the

Patna High Court CR. MISC. No.41852 of 2026(3) dt.31-07-2026 2/3 informant. It is further alleged that co-accused Badshah Khan assaulted the informant and snatched Rs. 3,000/- from the pocket of the informant. On the basis of the written report of the informant the case was registered.

4. The learned counsel for the petitioner submits that on suspicion, the petitioner has been apprehended and petitioner is having two criminal antecedents but he is on bail. It is further submitted that the charge-sheet has been filed.

5. The learned APP for the State vehemently opposes the prayer for regular bail of the petitioner.

6. Having heard the parties and taking into account that the charge-sheet has been filed and petitioner is in custody since 17.04.2026, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the likewise amount each to the satisfaction of the learned C.J.M., Kishanganj, in connection with Kishanganj P.S. Case No. 375 of 2026, subject to the following conditions:

(I) One of the bailors shall be the petitioner's own or close member.

(II) The petitioner shall appear on each and every date

Patna High Court CR. MISC. No.41852 of 2026(3) dt.31-07-2026 3/3 fixed during the trial and also co-operate in the process of trial. (III) The petitioner shall not tamper with the prosecution evidence or influence/intimidate any witness during the course of trial.

(IV) The Petitioner shall not commit offence of a similar nature in future.

7. In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.

8. Accordingly, the regular bail application stands allowed.
