The application is for grant of bail for the offence under Sections 399, 401, 414 of the Indian Penal Code as well as Section 25 (1-b)a/26/35 of the Arms Act.

It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner rather recovery has been made form the vehicle, wherein three persons were also sitting. It has further been submitted that the petitioner is in custody since 23.09.2016. Heard learned A.P.P. also, who opposes the prayer for bail of the petitioner on the ground that one loaded country-made Pistol has been recovered from the Vehicle.

Patna High Court Cr.Misc. No.54938 of 2016 (2) dt.23-12-2016 2/2 Having heard both sides. In view of the facts as stated above, I am not inclined to grant bail to the petitioner, however, the petitioner may renew for bail after framing of the charges in this case.
