Petitioner is languishing in judicial custody since 01.11.2016 in connection with Rampur P.S. Case No. 307 of 2016 registered for the offence punishable under Sections 25(1-b)A/26 of the Arms Act.
The prosecution case as alleged by the police personnel is that on information that some person has been murdered by firearm near Munni Masjid they proceed and found one country made pistol lying outside the house of the petitioner near water tank accordingly, a seizure list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent and is not named in the FIR and has been implicated only on the basis of suspicion and no specific
Patna High Court Cr.Misc. No.54637 of 2016 (2) dt.23-12-2016 allegation has been alleged against him and nothing has been recovered from his conscious possession.
However, learned A.P.P. for the State submits that petitioner is named in the FIR hence, opposes the prayer for bail. Be that as it may, considering the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 307 of 2016.
