JUSTICE SATYAVRAT VERMA ORAL ORDER 24-12-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in connection with Mahkar P.S. Case no. 53 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Amendment Act. Learned counsel for the petitioner submits that the petitioner is in custody since 19.7.2021 and charge sheet has been submitted. Allegation is recovery of 03 liters of country made liquor from the petitioner.
Learned APP opposes the prayer for bail.
Patna High Court CR. MISC. No.52395 of 2021(2) dt.24-12-2021 2/2 Considering the period of custody and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 5,00/- (five hundred) with two sureties of the like amount each to the satisfaction of the ADJ IIcum- Special Judge, Excise Act, Gaya in Mahkar P.S. Case no. 53 of 2021.
