JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Narpatganj P.S. Case no.30 of 2016, registered under Sections 304/34 of the Indian Penal Code.

The accusation is that four persons named in the F.I.R., including the petitioner, at the time of distributing of Mid Day Meal on 10.02.2016, refused to give mid day meal to the sister of the informant then she started weeping and moved to her house. When father of the informant reached at the school and made complaint then Md. Mastan caused injury through leg in which father of the informant fell down and died.

Learned counsel for the petitioner submits that petitioner is the cook and his name has been figured without any overt act against him. There is specific allegation against co-accused then Md.

Patna High Court Cr.Misc. No.55364 of 2016 (2) dt.23-12-2016 2/2 Mastan caused injury through leg to the father of the informant. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 30 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
