Looking at the advance age of petitioner No.1, the Court is inclined to give him benefit of doubt at this stage. Let petitioner No.1 Awdhesh Kumar Jha, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.20, 000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Tatarpur (Kotwali) P S Case No.01 of 2013, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. Taking into consideration the nature of allegation also made earlier against petitioner No.2 Anuj Kumar Jha by the informant,
Patna High Court Cr.Misc. No.37394 of 2013 (2) dt.24-12-2013 2 / 2 the Court is not inclined to give him benefit of doubt. Anticipatory bail application on behalf of petitioner No.2 is rejected. He may surrender before the court below and pray for regular bail.
