JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Special Case No. 4069 of 2017 arising out of Gardanibag P.S. Case No. 256 of 2017 instituted for the offences under Sections 38(1) (2) and 41 of the Bihar Prohibition and Excise (Amendment) Act, 2016.
The allegation is regarding recovery of 99 litres of illicit liquor from the car of the petitioner.
The learned counsel for the petitioner submits that the petitioner is owner of the car but the car was not being driven by him at the time when the recovery was made and he was not in the knowledge of the liquor being carried by the inmates of the
Patna High Court Cr.Misc. No.58906 of 2017 (2) dt.22-12-2017 2/2 car. It is submitted that the petitioner has a clean antecedent and he is in custody since 22.09.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No. 4069 of 2017 arising out of Gardanibag P.S. Case No. 256 of 2017.
