2. The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 35 of 2025, registered for the offences punishable under Sections 334(1) and 303(2) of the BNS, 2023.
3. As per allegation, on 06.12.2024, the petitioner broke into informant's sales building and stole Rs. 1,00,823/- from the cash counter.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He has further submitted that the FIR has been lodged after delay of 56 days without proper explanation for the delay. Both the parties are agnates to each other. It has further been submitted that one case mentioned in paragraph-3 of the bail
Patna High Court CR. MISC. No.42616 of 2025(5) dt.24-12-2025 2/2 petition, has been lodged by the informant itself.
5. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.
6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII/concerned Court, Darbhanga in connection with Baheri P.S. Case No. 35 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.
