The petitioner seeks regular bail in connection with Rajeev Nagar PS case no. 246 of 2017 instituted for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 541.5 ltrs. of illicit liquor from outside the school at Rajeev Nagar, Patna. The learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he was just a passer-by from the place where the alleged recovery has been made. It is further submitted that the petitioner has clean antecedent and he is in custody since 20.09.2017.

No.59768 of 2017 (2) dt.22-12-2017 2/2 Considering the nature of accusation, clean antecedent and the period of custody undergone, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Patna in connection with Rajeev Nagar PS case no. 246 of 2017. (Mohit Kumar Shah, J) rinkee/- U T
