The petitioner seeks regular bail in connection with Goh P.S. Case No. 135 of 2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of 61.5 litres of illicit English wine and 68 litres of country made liquor from the poultry farm of the petitioner.
The learned counsel for the petitioner submits that the said poultry farm had already been closed by the petitioner six months ago and was lying abandoned and it is not known as to who had planted the aforesaid liquor. It is submitted that the petitioner is accused in two other cases in which he is on bail and
Patna High Court Cr.Misc. No.58991 of 2017 (2) dt.22-12-2017 2/2 he is languishing in custody since 14.11.2017. Considering the nature of accusation and the period of custody already undergone, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VII cum Special Judge (Excise), Aurangabad in connection with Goh P.S.
