Ms. Pushpa Sinha-1 ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-12-2021 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Bhagwanpur P. S. Case No.80 of 2021, instituted for the offences under Section 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 14.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 196.875 litre of liquor from a blue colour Eicher tractor which belongs to the father of the petitioner and 216 litre of liquor is recovered from a truck as detailed in the F.I.R.

Patna High Court CR. MISC. No.53554 of 2021(2) dt.24-12-2021 2/2 The learned counsel for the petitioner submits that petitioner was not apprehended at the spot and he was not aware that the driver of the tractor has misused the tractor for the purposes of carrying liquor.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 14.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Begusarai in connection with Bhagwanpur P. S. Case No.80 of 2021.

The application stands allowed.
