Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in connection with Special Case no.4360/2021 arising out of Digha P.S. Case no. 388 of 2021 registered for the offence punishable under section 30(a) of Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 27.7.2021, is person with clean antecedent and charge sheet has been submitted. Allegation is
Patna High Court CR. MISC. No.53532 of 2021(2) dt.24-12-2021 2/2 recovery of 262.875 liters of liquor, cash and mobile from the house of Santosh Kumar. Learned counsel submits that admittedly, recovery is not from the house of the petitioner rather this petitioner was present in the house of Santosh Kumar as such he was also apprehended by the police on suspicion. Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody, is person with clean antecedent and charge sheet has been submitted, petitioner is directed to be released on bail on furnishing bail bonds of Rs 2,000/- (two thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in Special Case no.4360/2021 arising out of Digha P.S. Case no. 388 of 2021.
