Petitioners seek regular bail in connection with Excise Case No.481 of 2017 instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act,2016.
The allegation is regarding recovery of 704 litres of illicit foreign liquor from the TATA Pick Van which was being driven by petitioner no.1 and petitioner no.2 was sitting. The learned counsel for the petitioners submits that the petitioners are the driver and khalasi of the said van and the said illicit liquor was being carried on the said truck which was booked by someone else. The petitioners are having clean antecedent and are languishing in jail
Patna High Court Cr.Misc. No.60144 of 2017 (2) dt.22-12-2017 2/2 custody since 28.10.2017..
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners have got a clean antecedent, I direct the petitioners, named above, to be released on regular bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-2nd,, Gopalganj, in Excise Case No.481 of 2017.
