2. The application is filed for modification of the order dated 07.11.2025 passed in Cr. Misc. No. 37759 of 2025, whereby this Court has been pleased to extend privilege of anticipatory bail to the petitioner numbers 1, 2, 4, and 6. The prayer for bail of the petitioner numbers 3 and 5 were stood
Patna High Court CR. MISC. No.48891 of 2026(2) dt.31-07-2026 2/3 rejected by the aforesaid order.
3. Learned Advocate for the petitioners, at the outset, submits that during the pendency of the modification application, now petitioner number 2 has also been taken into custody, and as such, the modification application is only confined to petitioner numbers 1, 4, and 6. He further submits that while extending the privilege of anticipatory bail, this Court had put a condition that one of the bailors shall be own/close family members of the petitioner. But none of the family members are ready to become bailors. Therefore, the petitioner numbers 1, 4, and 6 are facing difficulty in furnishing their bail bond.
4. Having considered the submissions advanced by learned Advocate for the respective parties and taking note of the difficulties being faced by petitioner numbers 1, 4, and 6, this Court modified the order dated 07.11.2025 to the extent whereby, the condition has been imposed that one of the bailors shall be own/close family members of the petitioners. The petitioners are ready to furnish bail bond along with any bona fide bailors.
5. The order stands modified accordingly.
6. Further four weeks' time is extended to the
Patna High Court CR. MISC. No.48891 of 2026(2) dt.31-07-2026 3/3 petitioner numbers 1, 4, and 6 to surrender and furnish their bail bond.
