JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bhagwanpur P.S. Case No. 61 of 2017 registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code and sections 3⁄4 of the Dowry Prohibition Act. Learned counsel appearing for the petitioner submits that petitioner has been implicated in this case merely because she is mother of the husband of the deceased. As a matter of fact, since after the marriage of her son, this petitioner is residing separately from her son and the deceased. Nothing specific has been alleged against this petitioner. During investigation also, it has come that this is a case of suicide. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the
Patna High Court Cr.Misc. No.54636 of 2017(3) dt.22-12-2017 2/2 submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, III, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 61 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
